Last week’s article about the resolution of a lawsuit filed by former Morenci Elementary School principal Jeanie Thompson and her husband, Scott, was written without comment from the Thompsons’ attorney, Gregg Iddings. We called his office on Monday of last week and he returned our call on the following Friday.
We stated last week that no judgment was made against the school in relation to the lawsuit. A judgment on the four counts of the suit would have resulted only from a jury trial.
However, Iddings said, a judgment was granted for the Thompsons by Circuit Court Judge Timothy Pickard on the issue of “lack of consideration”—the school district’s failure to offer compensation when Thompson and other administrators accepted a new contract. Lack of consideration was a finding by the judge but was not part of the lawsuit.
Iddings also pointed out that three counts of the lawsuit—acting fraudulently and causing emotional distress and loss of consortium in the marriage—were not dismissed by the court but were voluntarily withdrawn by the Thompsons.
